1- Application of these terms and conditions

1.1 We welcome you to our electronic services, smartphone applications, and other electronic services (“Services”). These services are operated and maintained by MBC FZE.- LLC. M. M., a limited liability company registered in Dubai. p. M. ("Watch, we, us, ours"). Our registered office is located at Building 3, Dubai Media City, P.O. B. 72627, Dubai, United Arab Emirates. Our home page at http://mbc.net ("Our Page") is part of the Services.

1.2 These Terms of Use (“Terms”) apply to all of the Services and govern the relationship between us and each user of the Services (“you, the User”). Please read these terms carefully before beginning to use the Services. Your use of these services indicates that you accept these terms and that you agree to be bound by them. If you do not agree to these terms, please do not use the Services.

1.4 We may update these Terms from time to time in response to legal, regulatory or operational requirements. Any changes to these terms will be posted on this page. Where such changes are material, we may provide you with specific notice of any such changes (including when they will become effective) in accordance with law.

Where applicable we will make sure that you have the ability to accept these changes so that you can continue to use our services or refuse - in which case you have the right to cancel your use of the MBC services.

1.5 These Terms apply regardless of the type of device you use to access the Services (including a computer, laptop, mobile phone or tablet). These terms also apply if you access the Services through third party websites, provided that you are aware that the terms of the third party services (and their privacy policies) may also apply.

2- Access to the services

2.1 Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Services without prior notice. We are not responsible for the unavailability of the Services for any reason, at any time and for any period.

2.2 You are responsible for making all arrangements necessary to enable you to access the Services. You are also responsible for all persons using the Services through your internet line to know and comply with these Terms.

3- Our content

3.1 All rights, including, but not limited to, copyright, database rights and trademarks in and to the Services and their content, whether audio, text, images, video or otherwise ("Content"), are owned by and licensed to us. This content is also protected by copyright laws and agreements around the world. All such rights are reserved.

3.2 You agree to access the Services for personal use only and not for public or commercial use. You may not copy, publish, store in any medium, broadcast, transmit, retransmit, modify or publicly display any portions of the Content without our prior written consent.

3.3 You are authorized to use the Services for personal, non-commercial purposes, and you are not authorized to modify the Content or remove any copyright or other proprietary rights notices contained in the Content.

3.4 Comments and other content on the Services are not intended to provide advice for reliance on them, and we do not accept any responsibility or liability that may arise from any visitor to the Services reliance on such content or any person notified of such content.

3-5 We may change the content at any time. As necessary, we may suspend or close access to the Services indefinitely. The content may be out of date at some point and we are under no obligation to update that material.

3.6 If you print off, copy or download any part of the Services in breach of these Terms, your right to use the Services will cease immediately and you must, at our option, return or destroy any copies of such materials.

4- Contributions

Please read this section carefully before making any contributions to the Services.

4.1 When you are invited to make any Contribution on the Services (including any text, images, video or audio recordings) you and your licensee remain the owner of that content and grant us a perpetual, non-exclusive, sub-right and without claiming any worldwide copyright rights as you license We may use, copy, modify, publish, translate, derive works from, distribute, operate, display and communicate with the public and exercise all copyright and advertising rights in connection with that work and/or combine it with other works in any media now known or later developed for the entire term of any such rights granted to such content, in accordance with the privacy restrictions stated in our Privacy Policy http://www.mbc.net/ar/privacy.html. If you do not agree to grant those rights to us, you must refrain from making any contributions to our Services.

4.2 You are solely responsible for any contribution you make to our Services, and making any contribution to our Services means that you:

(i) you warrant that such Contribution is your own business and that you have the right to submit it to us for use for all of the above purposes; (ii) you agree to waive any moral rights in your Contribution for the purposes of submitting it and posting it on the Services and for using it for all of the above purposes; Your contribution does not infringe any rights of, limit or prohibit any third party's use and enjoyment of the Services; (iv) you warrant that your use of and contribution to the Services is lawful, not prohibited, does not cause harm or inconvenience to others, and does not contain any offensive or offensive material or interfere with the normal course of dialogue within Services.

4.3 You refrain, and do not encourage any other person, to make or submit any of the following:

(i) immediate, temporary or permanent withdrawal of your right to use the Services and/or any of its components; (ii) a notice to you; (iii) legal action against you to reimburse us for all costs on a compensation basis for the breach; (iv) further action legal right against you; and (5) disclose such necessary information to law enforcement authorities as we deem necessary.

We exclude liability for actions taken in connection with breaches of clauses 4.2 and 4.3 above. The responses in the above clause are unrestricted and we can take any other action we deem reasonably appropriate.

4.5 Although we require all users of the Services to abide by these Terms, you acknowledge the possibility that other users may place material on the Services that you may consider offensive or inappropriate. We do not have any responsibility or liability in connection with the content that such people place on the Services and such content does not reflect our opinions.

5- The age of majority

5.1 Please note that in some countries you must be 18 years of age or older to subscribe to the Services, or the age of majority may be over 18 years, in which case you must reach that age in order to subscribe to the Services. While individuals under the age of 18 may benefit from the services of MBC, they may do so only with the intervention, supervision and consent of a parent or legal guardian.

5.2 Contributions made and/or read by minors are subject to the consent of their parents or legal guardians. We advise parents or legal guardians who allow minors to use the Services to communicate with them about the importance of safety and caution in using the Internet.

6- Accounts and registration

6.1 We may from time to time offer a range of features through the Services which may require you to register or open an account. At any time you choose to register or open an account with us, the additional terms and conditions set out below will apply.

6.2 You are responsible for the use of your account and any other use of the account by family members. Allowing others to access your account is an acknowledgment of your responsibility to ensure their compliance with the Terms and an acknowledgment that you are responsible for their activities and behavior while using the Services.

6-3 All information provided upon registration must be correct and up-to-date. We may send you important alerts from time to time on your email registered with us, and accordingly, we will not be responsible for not receiving any important alert to you as a result of registering an inaccurate email address on your account or not checking your email periodically.

6-4 Please keep your password confidential. No representative of MBC will ask you to disclose your password. Please inform us as soon as you become aware or believe of any unauthorized use of your account. We also ask you to inform us if any of the information you provided us with when registering changes so that we can contact you when necessary. You can close your account provided that it is closed in accordance with the termination procedures described through our services.

6-5 In the event that your account is disabled, you will not be able to create a new account without our consent.

6.6 In the event that we determine, in our sole discretion, that you have breached the Terms, violated any law, rule or regulation, or if you have engaged in inappropriate behavior or for any other professional reasons, we reserve the right to immediately terminate or ban your account, your use of the Services or access to Content in At any time and without notice or responsibility. We also reserve the right to terminate your account or use of the Services or access to Content if your conduct constitutes an undue burden on our Services.

7- Competitions

From time to time we may place contests on the Services. If you want to participate in these competitions, you must at the time enter, agree and be bound by the terms and conditions of the competition and any additional terms and conditions that may exist at the time of the competition.

8- Links

8-1 You may link to our home page, provided you do so lawfully and fairly and not to damage our reputation or take advantage of it, but you may not create such link in a way that indicates any participation, approval or endorsement that we do not have.

8.2 You may not create any link from any Services that are not owned by you.

8.3 You may use our facilities on the Services to share content on social networks provided that the link to the original content is not deleted. However, you must not download any Content and then re-download it on another page, application, or other service. However, the presence of links on the services leading to a third party, these links are only for information and we do not assume any responsibility for these links and for any damage resulting from them and/or them.

8.4 It is prohibited to place the Services on any other Services, and you may not create a link to any part of the Services other than the home page. We reserve the right to withdraw any permission to create a link without any prior notice.

9 - Subscriptions and fees

9-1 There are no charges for using the Services unless clearly stated but the ISP/operator may charge a fee for using the speeds that the Services will require. When using the Service from a mobile device there may be some additional charges for using the network as per the terms of the contract with the operator Mobile device services.

9.2 Some Services offer paid Services for a subscription fee (“Fees”) in the Package and/or in-app purchase (“Paid Services”). The fees for these paid services may differ from one country to another, and they will be paid in the currency of the country in which the user is benefiting from the paid services, and local tax laws will apply to them.

9-3 We use a third party to complete the fee payment process and will not ask you for any banking or credit card information from you. Before using the paid services, it is recommended that the user inquire about any fees that will be deducted from the credit card or debit card, in favor of the credit card service provider or the debit card service (here, the bank). The credit card data that will be provided when using the services will be handled by the payment gateway and will not be given to MBC. The user is fully responsible for ensuring that the information entered in the relevant fields is correct.

It is recommended that you obtain and keep a copy of the transaction completion receipt for data archiving purposes, which may assist in settling any disputes that may arise from the use of paid services.

The user acknowledges his agreement, understanding and confirmation that his personal data without excluding any details related to the debit card, credit card or electronic payment transmitted over the Internet may be subject to misuse, hacking, theft or fraud, and that MBC and the payment gateway have no control over such things.

The paid service is provided through a payment gateway service on a secured website, however, the payment gateway and MBC cannot provide any guarantees that the information that the user will register on the Internet will be secure and cannot be read or viewed by a third party or will be hacked or any Viewing information is not authorized by the user.

We urge you to read the payment gateway's terms and conditions in this regard.

9.4 These Terms apply when you use the Paid Services through a coupon or limited offer that you obtained or purchased through us (“Limited Offer”). In addition, any set of terms and conditions included in the coupon or limited offer will apply.

9.5 We may from time to time offer free trial offers for paid services for a limited period of time (“Trial Offers”). We reserve the right, at our discretion, to determine whether you are entitled to take trial offers, and we may withdraw or modify trial offers at any time without any liability to us.

In this case, we will notify you via email.

9-6 Payment data may be required to benefit from some trial offers. At the end of the trial period, we may start deducting the fees for our paid services on the first day after the trial period ends, and periodically. Your submission of payment information in parallel with the trial period is an acknowledgment of your acceptance of the fees.

In the event that you do not wish to deduct this fee, you must change the subscription type for the free service through your registered account settings before the end of the trial period.

9-7 The user must understand that refunding fees is not available and that MBC will only grant a discount in the form of a free subscription as a form of compensation during a specified period. MBC will refund the fee if we determine that the user has been exposed to an invalid transaction, and we will determine the amount at our discretion. Some chargebacks will be available, but not through MBC and the user will need to request it himself such as the refund from "Apple iTunes" as per the specific terms and conditions of the application stores.

10- Our Responsibility

10.1 The Content on the Services is provided without any warranties, conditions or representations as to its accuracy.

10.2 With respect to your use of the Services, we and any group companies, officers, directors, employees, shareholders or agents thereof shall have no liability for the amount or type of any loss or damage that you or a third party may suffer (including without limitation any loss or damage punitive, direct or indirect, or any losses of revenue, profits, goodwill, data, contracts, use of funds, or losses and damages arising from or related to business interruption in any way, whether as a result of tort (including without limitation negligence), contracts or otherwise) in connection with the use, inability to use or consequences of using the Services, including without limitation any damage caused by viruses to your computer equipment, software, data or any property, due to your access to or use of the Services or browsing the Services.

10-3 The foregoing does not affect any liability that we cannot exclude or limit under applicable law.

11- Compensation

11.1 You agree to indemnify us and our respective affiliates, directors, officers, employees and agents, as well as their respective licensors and suppliers, from and against any and all claims, actions, suits or pleadings, and any and all losses, liabilities, damages, costs and expenses (including reasonable legal fees) which arise from:

11-1-1 any misrepresentation, act or omission by you in connection with your use of the Services; or 11-1-2 your failure to comply with any of these Terms and Conditions.

12- Jurisdiction and applicable law

12.1 The courts of Dubai, United Arab Emirates shall have exclusive jurisdiction over any claim arising out of or relating to a visit to the Services.

12.2 These Terms and any dispute or claim arising out of or relating to them, their subject matter or their formation (including non-contractual disputes or claims) shall be governed by the laws of the United Arab Emirates
